Capital Remodeling Inc. is a bad-faith pusher of home renovations that locks customers into one-sided contracts the company itself won’t commit to.
On top of reports on the Better Business Bureau’s website about Capital Remodeling Inc.’s forging signatures on contracts, the fraudster’s “contracts” are one-sided and, in fact, the scammers don’t trust their own salespeople to execute them:
All orders are subject to acceptance by CAPITAL REMODELING, INC. This Agreement is not binding on CAPITAL REMODELING, INC. (CAPITAL) unless accepted by at [sic] its corporate headquarters, and if such acceptance is declined by CAPITAL for any reason, all deposit monies will be refunded in full, with no further responsibility or liability hereunder to Seller.
The rest of the contract is just as one-sided and customer unfriendly.
The contract contains onerous cancelation terms, essentially granting Capital Remodeling the entire contract price if suckers—sorry, customers—attempt to cancel after the recission period: only three days (Maryland residents are afforded the luxury of five business days if under the age of 65 or seven if over)! That’s right, attempt to cancel an order after three days and you may owe Capital Remodeling the full contract price.
Contract signers are “marrying” Capital Remodeling, and your new spouse is bitter and litigious:
Further, upon default of Buyer(s) at any time after the rescission period but before the Seller orders materials and products, CAPITAL REMODELING, INC. shall be entitled to reimbursement from Buyer(s) for costs and expenses in the minimum amount of thirty percent (30%) of the contract price as liquidated damages. Any cancellation after the Right of Rescission will also forfeit any of the Buyer(s)' down payments or deposits to CAPITAL
How might a buyer default?
(a) default in the payment of the contract price; (b) failure of the Buyer to cooperate with CAPITAL REMODELING, INC. in obtaining financing on the Buyer's behalf, (c) any warranty, representation or statement proving to have been false in any material respect when made or furnished to CAPITAL by or on the behalf of the Buyer in connection with this Agreement or to induce CAPITAL REMODELING, INC. to extend credit to Buyer; (d) failure of the Buyer to provide a right of access to the jobsite location for CAPITAL at reasonable times during the hours of 7:30 a.m. to 6:00 p.m., Monday thru Friday to perform the service contemplated by this Agreement: (e) If Buyer refuses to show proof of balance within 30 days of CAPITAL'S initial verbal or written request as per the paragraph below regarding Proof of Balance: (f) If Buyer's job site location is unsafe, unreasonably cluttered with objects, has a strong odor, excessively dirty, has pests or insects, or has individuals located at the jobsite location that greatly interfere or distract CAPITAL'S workers and Buyer(s) refuses to pay and/or rectify the jobsite area to be in workable condition as per CAPITAL'S discretionary standards within a 30 day period from CAPITAL'S request to fix such conditions. Further, if Buyer(s) in default and does not allow right of access within 2 months of estimated installation date, products may be destroyed at CAPITAL'S discretion, to avoid storage costs. and Buyer will still be responsible for entire contract price without CAPITAL having to remake products, or at CAPITAL'S sole discretion, CAPITAL may agree to a set delay time period with Buyer(s), and in turn Buyer(s) agrees to pay a 2% increase to the total contract price for each month of delay to cover storage fees and potential inflation of project costs.
